Ireland

With an estimated 60% share of the global aviation leasing market, Ireland is the aviation hub of the European Union. It is home to more than 50 aircraft leasing companies, 14 of which are counted among the top 15 in the world.  It is said that an Irish leased aircraft takes off somewhere in the world every two seconds!

This dominant share of the market can largely be explained by the favorable tax and business environment the country offers. The tax regime is highly supportive of the aviation sector, with an attractive 12.5% corporation tax rate and an eight-year capital write-off for aircraft assets. This efficiency can also be leveraged internationally through Ireland’s extensive network of tax treaty partners.

Malta

In recent years, Malta has become a regional center for aircraft registration, sales and acquisitions, and financing structures, as well as an attractive destination for aircraft importation (both private and commercial) and AOC registration. This success has largely been driven by the fact that Malta is an EU member where English is an official language and its geographical position has continued to attract regional companies.

As well as being tax and cost-efficient as a jurisdiction, in recent years various legal developments in Malta have also contributed to its success as an aviation hub. For instance:

  • The current regulatory framework allows for registration of types of aircraft that are not necessarily related to commercial air transport;
  • There is an option to recognize fractional ownership of aircraft so the title can be shared between co-owners (with no set percentages). Such ownership fractions may each be financed by a different creditor who in turn takes security over that particular fractional interest for which finance has been provided;
  • It is possible to register aircraft under construction (provided they are uniquely identifiable).

It is also worth mentioning that the Maltese law implements the provisions of the Cape Town Convention on International Interests in Mobile Equipment and its Aircraft Protocol. Such provisions grant secured lenders a higher degree of protection and more effective remedies while allowing lower borrowing costs. Given its geographical position and relatively low labor costs, Malta is a regional hub for several airlines’ maintenance centers. It provides a vast array of dedicated technical services targeted at the aviation industry, such as aircraft and engine maintenance, aircraft management, repair and overhaul, aircraft maintenance training and support services.
